1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Backend Babe website and services. Backend Babe is a DBA of Karissa Starcevich, a sole proprietorship based in Palm Bay, Florida. By accessing our website or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our services.

3. Eligibility & Right to Refuse Service

Backend Babe services are available to businesses only. You must be at least 18 years of age and have the authority to enter into agreements on behalf of your business.

Backend Babe reserves the unrestricted right to refuse service, decline onboarding, or discontinue services to any business or individual at any time, for any reason or no reason, with or without notice.

You agree to provide accurate, current, and complete information at all times.

4. Services Provided

Backend Babe provides marketing and technical services including, but not limited to:

Marketing services

CRM and GoHighLevel (GHL) setup and management

Automation and workflow development

SMS and email marketing setup

Funnel and website builds

Consulting and coaching

Subscription-based services

Templates and digital assets

Services may be offered as one-time purchases, ongoing subscriptions, or both. Certain services require minimum commitments, timelines, or usage limits, which are disclosed at checkout or within service agreements.

Many services are custom-built and heavily guided by client input, approvals, and direction.

5. Payments, Billing & Refund Policy

Backend Babe accepts payment via Stripe (including Affirm, Klarna, AfterPay), PayPal (including PayPal Credit), bank transfers, and major credit or debit cards.

All sales are final. No refunds are offered.

Pricing may change at any time; however, active subscription clients will retain their current pricing unless they modify or cancel their subscription. Clients may upgrade or downgrade subscriptions as needed.

Failure to submit payment may result in suspension or termination of services.

6. Platform Charges, Usage & Client Budgets

Clients are fully responsible for all platform-related charges, including but not limited to:

SMS and email usage

AI features

Call tracking

Advertising spend

Additional GoHighLevel features

Clients must maintain sufficient balances (“top-ups”) within their accounts. Backend Babe cannot reimburse or reverse charges, including overages caused by system errors, automations, or user misconfiguration.

Clients are responsible for actively monitoring spending to ensure it does not exceed their personal or business budget.

Some AI features or platform services may incur charges without explicit notification. Clients must confirm costs before using unfamiliar features. Use of such features constitutes acceptance of associated charges.

Carrier-imposed ramp-up limits apply to SMS and email sending volumes. These limits are outside of Backend Babe’s control. When thresholds are reached, access may be temporarily restricted or removed.

7. Subscriptions, Commitments & BB Bucks

Certain ongoing services require a three (3) month minimum commitment.

To remain active in ongoing support:

A minimum of two (2) BB Bucks per month is required

BB Bucks do not roll over and may only be used during the month purchased

There is no pause option; however, clients may reduce to the minimum to retain their spot

During reduced months, Backend Babe may provide templates or services applicable to the client’s current or future needs

If services are canceled:

Clients may be added to the Backend Babe waitlist

Ongoing support is limited to 10 clients at any given time, unless additional spots are offered at Backend Babe’s discretion

Waitlist placement is first-come, first-served

8. Platform Access & Software Use

Backend Babe aims to provide platform access (including GHL) at no additional cost with ongoing services. However:

Platform access is not guaranteed indefinitely

A software fee may apply in the future if the business model changes

Clients will not lose access to their Backend Babe content upon canceling ongoing services, but accounts may be paused if platform access is no longer available to unpaid clients

Clients may transfer their account to another agency or their own agency at any time, subject to GoHighLevel’s current policies and pricing.

9. Timelines, Calls & Service Delivery

Service timelines depend on:

Client responsiveness

Approved direction

Attendance at scheduled calls

For one-time services, missed calls or delayed communication may significantly extend timelines.

For ongoing support, failure to attend calls or engage within the support window may result in missed services. Unused support time does not roll over.

If a client misses scheduled calls, Backend Babe may proceed with fulfillment based on previously approved direction to maintain service standards.

10. Client Responsibilities & Revisions

Clients are solely responsible for:

Their content, messaging, and campaigns

Ensuring compliance with applicable laws (including TCPA, CAN-SPAM, and carrier regulations)

Obtaining proper consent from contacts

The accuracy and legality of data uploaded into their systems

Clients must:

Provide clear, timely guidance

Review work promptly

Communicate revision requests clearly

Revision requests must be submitted within the same month the work was created. Requests outside this window are considered new work and billed at current rates or become the client’s responsibility.

11. SMS, Email & A2P Messaging Compliance

Backend Babe uses GoHighLevel and related tools to send SMS and email messages, including:

Appointment reminders

Marketing and promotional messages

Account notifications

Support and fulfillment communications

Users opt in via website forms, booking forms, and lead forms. Message and data rates may apply. Consent is not a condition of purchase.

All SMS communications include standard opt-out language (e.g., “Reply STOP to unsubscribe”).

12. Prohibited Uses

You may not use Backend Babe services for:

Spam or unsolicited messaging

Illegal, deceptive, or fraudulent practices

Violations of carrier, platform, or advertising policies

Content that violates applicable laws

Backend Babe serves clients in the boudoir photography industry. While some platforms may consider this adult-adjacent, explicit or unlawful content is strictly prohibited.

13. Intellectual Property

All templates, systems, frameworks, and content created by Backend Babe remain the property of Backend Babe, unless exclusivity is purchased (available for custom builds only).

Clients own:

Content they personally write

Content manually added to their system

Custom-built content may be resold by Backend Babe unless exclusivity is purchased. When exclusivity is added:

Clients own the original content and campaign structure

Backend Babe may reuse the campaign framework (“shell”) in a materially different form without identifiable elements

Copywriting is not included unless explicitly purchased, selected with BB Bucks, or stated at checkout. When copywriting is included, clients own the materials written specifically for them.

14. Troubleshooting & Third-Party Limitations

Backend Babe cannot guarantee solutions for all technical or platform-related issues. Some issues may be caused by third-party systems, carriers, or software limitations beyond our control.

While reasonable efforts may be made to seek third-party support, any costs incurred due to account-specific issues may be passed on to the client.

15. Termination & Suspension

Backend Babe reserves the right to suspend or terminate services for reasons including, but not limited to:

Nonpayment

Excessive revisions or requests outside purchased services

Policy violations

Abuse of systems or platforms

Illegal or non-compliant activity

Clients may cancel services at any time, subject to applicable commitments.

16. Disclaimer & Limitation of Liability

Backend Babe does not guarantee results from marketing, email, SMS, or advertising campaigns. All investments are made at the client’s own risk.

Backend Babe is not liable for:

Lost revenue or profits

Data loss

Budget overruns

Platform shutdowns or changes (Meta, carriers, GHL, etc.)

Compliance issues caused by client actions

Service interruptions or limit restrictions

Poor performance of templates or custom-built materials

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States.

18. Changes to These Terms

Backend Babe may update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
